Design and Building Practitioners Regulation 2021 (NSW)

The NSW government has appointed a Building Ombudsman to review the construction process in NSW. This new Act describes reforms to the process and the Regulation provides the detail for the first stage of the implementation of the Act.

Further stages are proposed which will be particularly relevant to AIH members. The legislation enables consumers to have specific people and not businesses responsible for the structural integrity, safety and management of new developments (the first stage is for high rise residential) for a specified 10 year period from the date of development completion.

The workability of the Act and accompanying future Regulations are no doubt being watched by other States so they can establish their own legislation to mirror or build on the NSW legislation. Two issues of potential concern to AIH members in the next stage are the fire-proof issues that may develop with vertical gardens over 10 years and the structural, water proofing and management issues associated with roof gardens over 10 years.

There may also be other issues. The legislation ensures compliance with the National Construction Code which includes building codes and standards. There is one Australian Standard which requires our attention AS2870-2011 Residential Slabs and Footings. This has particular requirements for plantings, irrigation, drainage etc. for new residential houses.

Presenter: Mr Graham Fletcher MAIH RH Australian Institute of Horticulture Ambassador, Fellow of the Australian Institute of Landscape Architects. Graham is a former educator at TAFE NSW and former lecturer and administrator at University of NSW. Graham has extensive experience as a Horticulturist, Landscape Gardener, Landscape designer and Landscape Architect, Educator and Administrator and has received many awards for teaching, design, administration and management.
